These Terms of Service ("Terms") govern your use of the website located at adaptabilitystore.ca, the AdaptAbility mobile application, our online and mobile shopping services, customer accounts, and other services provided by AdaptAbility Store Inc.

Please read these Terms carefully.

By accessing or using our website or mobile application, creating an account, placing an order, purchasing products or services from us, or otherwise using our Services, you agree to these Terms.

If you do not agree with these Terms, you should not use our Digital Services.

Nothing in these Terms is intended to limit, exclude or waive any right or remedy that cannot lawfully be limited, excluded or waived under applicable consumer protection or other legislation.


1. About AdaptAbility

AdaptAbility Store Inc. ("AdaptAbility," "we," "us," or "our") is a Canadian retailer based in Calgary, Alberta.

We sell accessibility, adaptive, mobility, sensory, educational, recreational and related products through:

  • Our website at adaptabilitystore.ca

  • The AdaptAbility mobile application ("App")

  • Our physical retail location

  • Telephone and email orders

  • Quotations and purchase orders

  • Institutional and organizational sales

Our website, App, customer accounts and related digital functionality are collectively referred to as our "Digital Services."

Our Digital Services, retail operations, products and other services are collectively referred to as the "Services."


2. Eligibility and Age Requirements

Our website, App and purchasing services are intended for persons who are legally able to enter into contracts.

By using our Services, you represent that you are at least the age of majority in the province, territory, state or jurisdiction where you reside, or that you are using our Services under the supervision or with the consent of a parent or legal guardian where appropriate.

Products sold by AdaptAbility may be designed for children or other persons who are not themselves legally able to enter into contracts. Purchases for such individuals should be made by a parent, guardian, caregiver or other authorized adult.


3. Acceptance of These Terms

By accessing our Digital Services or purchasing from AdaptAbility, you agree to be bound by:

  • These Terms of Service

  • Our Privacy Policy

  • Our Returns and Refunds Policy

  • Any shipping or delivery terms disclosed during checkout

  • Any product-specific terms disclosed before purchase

  • Any separate written quotation, purchase agreement or other contract that applies to your transaction

Where there is a conflict between these Terms and a specific written agreement separately negotiated and accepted by AdaptAbility, the specific written agreement will govern to the extent of the inconsistency.

We may update these Terms from time to time to reflect changes to:

  • Our business

  • Our website or App

  • Our products or services

  • Our technology

  • Applicable laws

  • Our operating practices

The date shown at the top of these Terms indicates when they were last updated.

Changes generally apply prospectively and do not alter the terms governing an order that was already accepted before the change, except where required by law.

Your continued use of our Digital Services after updated Terms become effective constitutes acceptance of the updated Terms as they relate to your continued use of the Services.


5. Shopify and Our Online Store

Our online store is powered by Shopify.

Shopify provides technology that allows us to display products, operate our online store, maintain customer accounts, manage shopping carts and facilitate checkout and order processing.

A contract for the purchase of products from AdaptAbility is between the customer and AdaptAbility Store Inc., not Shopify, unless expressly stated otherwise.

Shopify may provide additional consumer-facing services or functionality subject to Shopify's own terms and privacy policies.


6. The AdaptAbility Mobile App

The AdaptAbility App allows customers to access certain AdaptAbility shopping and account features from a compatible mobile device.

Depending on the version of the App and features available at the time, these may include:

  • Browsing products

  • Searching products

  • Browsing product categories

  • Viewing product availability

  • Accessing customer account functionality

  • Adding products to a shopping cart

  • Proceeding to checkout

  • Receiving back-in-stock notifications

  • Receiving push notifications

  • Accessing order or account information

  • Other shopping-related functions

We may add, remove, modify, suspend or discontinue App features from time to time.

We do not guarantee that every feature available on our website will be available in the App or vice versa.


7. App Licence

Subject to these Terms, AdaptAbility grants you a limited, personal, revocable, non-exclusive, non-transferable licence to download and use the AdaptAbility App on a compatible device for your own lawful personal or business purchasing purposes.

You may not:

  • Copy the App except as permitted by law

  • Sell, rent, lease, sublicense or redistribute the App

  • Reverse engineer, decompile or attempt to derive the source code of the App except where such restriction is prohibited by law

  • Modify the App without authorization

  • Circumvent App security features

  • Use the App to gain unauthorized access to AdaptAbility or third-party systems

  • Use the App for unlawful purposes

All rights not expressly granted to you remain reserved by AdaptAbility and its applicable licensors.


8. Apple, Google and Other App Platforms

If you download the App through the Apple App Store, Google Play or another third-party app marketplace, your use of that platform may also be subject to the platform provider's terms.

AdaptAbility, not Apple, Google or another app-store provider, is responsible for the AdaptAbility App and for customer support related to the App, subject to these Terms.

App-store providers are not responsible for:

  • AdaptAbility products

  • Product warranties

  • Order fulfillment

  • Customer service

  • Refunds or returns

  • Product suitability

  • AdaptAbility's business operations

except to the extent required by applicable platform terms or law.


9. Customer Accounts

You may be able to create or use a customer account through our Digital Services.

You are responsible for:

  • Providing accurate account information

  • Maintaining the confidentiality of authentication credentials

  • Protecting access to your email account and mobile device

  • Notifying us if you believe your account has been accessed without authorization

You may not use another person's account without authorization.

We may suspend or restrict access to an account where we reasonably believe:

  • It has been compromised

  • Fraud is occurring

  • The account is being misused

  • These Terms have been violated

  • Suspension is reasonably necessary to protect customers, AdaptAbility or third parties


10. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs, pricing, availability and other information displayed through our Services are accurate.

However, errors or differences may occasionally occur.

For example:

  • Product colours may appear differently depending on a screen or device

  • Packaging may change

  • Manufacturers may change specifications

  • Product photographs may show accessories that are sold separately

  • Dimensions may be approximate

  • Product availability may change rapidly

  • Manufacturer information may change without notice

Customers should review the applicable product description, specifications and manufacturer information before purchasing.

If a particular feature, measurement, compatibility requirement or specification is essential to your purchase, we encourage you to contact us before ordering.


11. Accessibility Products and Product Suitability

AdaptAbility sells products designed to assist individuals with a wide range of accessibility, mobility, sensory, developmental, educational and daily-living needs.

Individual needs vary considerably.

A product that is appropriate for one person may not be appropriate for another.

Unless expressly stated otherwise, product information provided by AdaptAbility is intended for general informational and retail purposes and is not medical, occupational therapy, physiotherapy or other regulated healthcare advice.

Recommendations made by our staff are based on:

  • Information provided by the customer

  • Product information supplied by manufacturers

  • Our experience with the products we sell

Customers remain responsible for determining whether a product is appropriate for the intended user.

Where product suitability depends upon factors such as:

  • Medical condition

  • Mobility

  • Body size or weight

  • Positioning needs

  • Behavioural considerations

  • Sensory needs

  • Developmental needs

  • Transportation safety

  • Physical limitations

  • Clinical recommendations

we strongly encourage customers to consult an appropriate qualified professional where necessary.


12. Manufacturer Instructions and Safety Requirements

Products must be assembled, installed, operated, maintained and used in accordance with:

  • Manufacturer instructions

  • Product warnings

  • Weight limits

  • Age recommendations

  • Safety instructions

  • Installation requirements

  • Applicable laws and regulations

Customers are responsible for reviewing applicable product documentation before use.

Failure to follow manufacturer instructions may create safety risks and may affect warranty coverage.


13. Prices

Unless otherwise stated, prices displayed through our Canadian Services are in Canadian dollars.

Applicable taxes and shipping, freight, delivery or other charges will be disclosed as required before completing an order.

Prices may change without notice before an order is accepted.

A product appearing in a shopping cart does not guarantee that its price will remain unchanged before checkout.

Promotional pricing may be subject to:

  • Start and end dates

  • Quantity limits

  • Inventory availability

  • Eligibility requirements

  • Promotional terms


14. Pricing Errors

Despite reasonable efforts, pricing errors may occasionally occur.

If a product is listed at an obviously incorrect price due to:

  • Typographical error

  • System malfunction

  • Supplier error

  • Pricing feed error

  • Technical issue

we may contact you before fulfilling the affected portion of the order.

Where permitted by law, we may:

  • Offer to fulfill the item at the correct price

  • Ask whether you wish to proceed

  • Cancel and refund the affected item

  • Cancel and refund the order where reasonably necessary

We will not knowingly use pricing errors as a means of misleading customers.

Nothing in this section limits rights provided by applicable consumer protection legislation.


15. Product Availability

Product availability displayed on our website or App represents our best available inventory information but may not always reflect real-time availability.

Inventory may change between the time a product is:

  • Viewed

  • Added to a cart

  • Ordered

  • Processed for fulfillment

An item appearing to be in stock does not guarantee availability until the order has been accepted and allocated for fulfillment.

Inventory discrepancies may occasionally occur as a result of:

  • Simultaneous purchases

  • In-store sales

  • Institutional orders

  • Inventory counting differences

  • Damaged inventory

  • Supplier availability

  • System synchronization delays

  • Previously committed stock

If an item becomes unavailable after you order it, we will take reasonable steps to contact you and provide available options.


16. Backorders and Oversold Products

Some products may temporarily be unavailable or backordered.

Where appropriate, we may allow customers to place orders for products that are expected to become available.

Estimated availability dates are estimates only unless expressly guaranteed.

Manufacturer production, international shipping, customs clearance, freight transportation and other circumstances may affect timing.

Where an item is significantly delayed, we may contact you regarding available options, subject to applicable consumer rights.


17. Back-in-Stock Notifications

Our website or App may allow you to request a notification when a product returns to stock.

A back-in-stock notification:

  • Is provided for convenience

  • Does not reserve inventory

  • Does not guarantee availability

  • Does not guarantee the product will remain available until you complete checkout

  • Does not create a contract to supply the product

Products may sell out quickly after a notification is sent.

We do not guarantee that every requested notification will be successfully delivered.


18. Special Orders

Certain products may be specially ordered from a manufacturer, supplier or distributor for a specific customer.

Special orders may be subject to:

  • Deposits

  • Longer lead times

  • Manufacturer availability

  • Freight charges

  • Different cancellation conditions

  • Different return conditions

Any special-order restrictions will be disclosed where reasonably practicable before the customer becomes contractually bound.

Nothing in our special-order policy removes rights that cannot lawfully be waived under applicable consumer protection legislation.


19. Pre-Orders

From time to time, we may allow customers to pre-order products that have not yet arrived or become generally available.

Any anticipated:

  • Release date

  • Arrival date

  • Shipping date

  • Manufacturer availability date

is an estimate unless expressly stated to be guaranteed.

Pre-order timing may change due to circumstances outside our control.


20. Placing an Order

Submitting an order through our website or App constitutes an offer to purchase the products identified in the order.

An automated email or screen confirming that we received your order does not necessarily constitute final acceptance of the order.

We may review an order before acceptance for matters including:

  • Product availability

  • Pricing

  • Payment authorization

  • Fraud prevention

  • Shipping feasibility

  • Regulatory or geographic restrictions

  • Obvious errors

An order may be accepted when we confirm acceptance, process the order for fulfillment or shipment, or otherwise indicate that the order has been accepted.

23. Accurate Customer Information

You agree to provide accurate, current and complete information when placing an order or creating an account.

This includes, where applicable:

  • Name

  • Billing information

  • Shipping address

  • Email address

  • Telephone number

  • Payment information

You are responsible for reviewing information before submitting an order.

Additional costs resulting from an incorrect address or other incorrect information provided by the customer may be the customer's responsibility where permitted by law.


24. Payments

We accept payment methods displayed during checkout or otherwise approved by AdaptAbility.

Payments may be processed by third-party payment processors.

We do not normally receive or store complete payment-card information.

By submitting payment information, you represent that:

  • You are authorized to use the payment method

  • The information provided is accurate

  • You authorize the applicable charges

Payment authorization does not necessarily constitute final acceptance of an order.


25. Taxes

Applicable federal, provincial and other taxes will be charged where required by law.

Customers claiming tax-exempt status are responsible for providing appropriate documentation where applicable.


26. Shipping and Delivery

Shipping options and charges may vary depending on:

  • Product size

  • Product weight

  • Destination

  • Carrier

  • Service level

  • Freight requirements

  • Supplier location

  • Delivery requirements

Delivery dates are estimates unless expressly guaranteed.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

  • Carrier delays

  • Weather

  • Customs

  • Border delays

  • Labour disruptions

  • Manufacturer delays

  • Transportation disruptions

  • Natural disasters

  • Government action

This does not limit statutory rights concerning delayed delivery.


27. Freight and Oversized Products

Certain products may require freight or specialized delivery because of their:

  • Packaging

  • Handling requirements

Freight delivery may differ from ordinary parcel delivery.

Unless expressly included in the service purchased, freight delivery may not include:

  • Inside delivery

Additional charges may apply for services requested beyond the agreed delivery service.


28. Remote and Difficult-to-Service Locations

Shipping charges displayed online may occasionally require adjustment for destinations involving:

  • Limited-access areas

  • Specialized freight

  • Unusual delivery conditions

Where an additional charge is necessary and cannot reasonably be calculated at checkout, we will contact the customer before imposing the additional charge where required.

The customer may choose not to proceed where permitted under applicable law and the circumstances of the transaction.


29. Delivery Inspection and Shipping Damage

Customers should inspect delivered products as soon as reasonably possible.

If packaging or a product appears damaged in transit, please:

  • Photograph the packaging

  • Photograph the product

  • Retain packaging where practicable

  • Contact AdaptAbility promptly

Certain freight carriers may require visible damage to be noted at delivery.

Failure to report damage promptly may make carrier claims more difficult, but nothing in this section removes rights available under applicable law.


30. Returns and Refunds

Returns, refunds and exchanges are governed by our Returns and Refunds Policy, together with applicable consumer protection legislation.

Certain products may have different return eligibility due to factors including:

  • Hygiene considerations

  • Personal use

  • Custom manufacture

  • Special ordering

  • Safety

  • Opened packaging

  • Manufacturer restrictions

Any applicable restrictions are subject to rights that cannot legally be excluded or waived.


31. Manufacturer Warranties

Certain products may be covered by a manufacturer's warranty.

Manufacturer warranties may vary by product.

Where appropriate, AdaptAbility may assist customers with a manufacturer's warranty process, but the warranty itself may be provided by the manufacturer rather than AdaptAbility.

Nothing in these Terms limits rights or warranties that cannot lawfully be excluded under applicable legislation.


32. Institutional and Organizational Customers

AdaptAbility sells products to organizations including:

  • Schools

  • School boards

  • Healthcare providers

  • Government agencies

  • Municipalities

  • Transportation providers

  • Nonprofit organizations

  • Businesses

  • Other institutions

Institutional transactions may be subject to separate terms stated in:

  • Quotations

  • Purchase orders

  • Credit agreements

  • Invoices

  • Written contracts

  • Procurement agreements

Where AdaptAbility expressly accepts different terms for an institutional transaction in writing, those accepted terms govern that transaction to the extent they conflict with these Terms.


33. Quotations

Unless otherwise stated, a quotation:

  • Is valid for the period specified on the quotation

  • Is subject to product availability

  • May be subject to applicable taxes

  • May include or exclude shipping or freight as stated

  • May change if the scope or quantity changes

A quotation is not necessarily a guarantee of inventory availability unless expressly stated.


34. Purchase Orders

AdaptAbility may accept purchase orders from approved organizations.

Acceptance of a purchase order is subject to AdaptAbility's approval.

A customer's standard purchase-order terms do not automatically amend these Terms or a quotation simply because they appear on a purchase order.

Any terms that materially alter the agreement must be expressly accepted by AdaptAbility where required.

Separate payment terms may apply to approved institutional customers.


35. Late Payments and Credit Terms

Where AdaptAbility extends credit or payment terms, payment is due according to the terms stated on the applicable:

  • Invoice

  • Quotation

  • Purchase agreement

  • Credit agreement

  • Accepted purchase order

Late-payment charges, if applicable, will be disclosed in the agreement governing the transaction and will be subject to applicable law.


36. Retail Store Transactions

Certain terms in this agreement apply specifically to Digital Services, while others apply to purchases generally.

In-store purchases may also be subject to:

  • Posted store policies

  • Product-specific conditions

  • Our Returns and Refunds Policy

  • Applicable consumer laws

Where an online-specific provision clearly does not apply to an in-store transaction, it will not be interpreted as applying to that transaction.


37. Promotions and Discount Codes

Promotions, coupon codes and discounts may be subject to additional terms.

Unless otherwise stated:

  • Discounts cannot be redeemed for cash

  • Discounts may have expiry dates

  • Some products may be excluded

  • Promotions may not be combined

  • Quantity limits may apply

  • Promotional inventory may be limited

We reserve the right to reject fraudulent or unauthorized use of a promotion.


38. Gift Cards

If AdaptAbility offers gift cards, their use may be subject to separate terms.

Gift-card terms will comply with applicable consumer protection legislation.

Many products sold by AdaptAbility are manufactured by third parties.

Product:

  • Specifications

  • Warranties

  • Instructions

  • Safety warnings

  • Certifications

may therefore originate with the applicable manufacturer.

Manufacturer trademarks and product names remain the property of their respective owners.


40. Third-Party Links and Services

Our website or App may contain links to third-party websites or services.

These may include:

  • Suppliers

  • Community organizations

  • Social-media platforms

  • Payment providers

  • External informational resources

We do not control third-party websites.

A link does not necessarily mean that we endorse every statement, product, policy or practice of the linked organization.

Use of third-party services may be subject to separate terms and privacy policies.


41. User Reviews, Comments and Content

Our Services may allow customers to submit:

  • Photographs

  • Feedback

  • Testimonials

  • Other content

You remain responsible for content you submit.

You must not submit content that:

  • Is unlawful

  • Is defamatory

  • Infringes intellectual property rights

  • Invades another person's privacy

  • Contains malicious software

  • Is fraudulent or misleading

  • Contains inappropriate confidential information


42. Licence for Published User Content

Where you intentionally submit content for publication, such as a product review or testimonial, you grant AdaptAbility a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes connected with our business and Services.

This licence does not give us unrestricted rights to publish sensitive personal information merely because it was provided in a private customer-service communication.

Personal information remains subject to our Privacy Policy.


43. Feedback and Suggestions

If you voluntarily provide general feedback or suggestions concerning our website, App, products or Services, we may use that feedback to improve our business without an obligation to compensate you.

This does not transfer ownership of unrelated confidential or personal information you provide to us.


44. Intellectual Property

Unless otherwise indicated, content created or owned by AdaptAbility through our Digital Services, including applicable:

  • Text

  • Graphics

  • Branding

  • Logos

  • Layouts

  • Software

  • App content

  • Original photographs

  • Videos

  • Written materials

is owned by or licensed to AdaptAbility and is protected by applicable intellectual property laws.

You may use our Services and content for ordinary personal shopping and informational purposes.

You may not commercially reproduce or exploit AdaptAbility-owned content without permission.


45. Prohibited Uses

You may not use our Digital Services:

  • For unlawful purposes

  • To violate applicable laws

  • To infringe intellectual property rights

  • To impersonate another person

  • To submit fraudulent information

  • To conduct unauthorized scraping or automated data collection

  • To upload malware or malicious code

  • To interfere with security

  • To attempt unauthorized access to systems

  • To collect another person's personal information unlawfully

  • To abuse promotional programs

  • To carry out payment fraud

  • To interfere with the normal operation of our Services

  • New functionality

Older versions of the App may eventually stop functioning.

We do not guarantee compatibility with every:

  • Mobile device

  • Operating system

  • Operating-system version


48. Push Notifications

If you enable push notifications, we may send notifications related to features you have requested or communications you have agreed to receive.

You can generally disable push notifications through your device settings.

Push notifications may be delayed or fail because of circumstances outside our control, including:

  • Device settings

  • Internet connectivity

  • Operating-system restrictions

  • Notification-service outages

Our collection, use, disclosure and protection of personal information is governed by our Privacy Policy.

By using our Services, you acknowledge that personal information will be handled as described in that policy.


50. Fraud Prevention

We may use reasonable fraud-prevention measures.

We may contact customers to verify information such as:

  • Payment authorization

We may delay or refuse an order where we reasonably suspect fraud or unauthorized activity.


51. Disclaimer Concerning Digital Services

To the maximum extent permitted by applicable law, our website, App and related digital functionality are provided on an "as available" basis.

We do not guarantee that:

  • Digital Services will always be available

  • Digital Services will be error-free

  • Every technical problem will immediately be corrected

  • Notifications will always be delivered

  • Product availability information will always update instantaneously

This section relates principally to Digital Services and does not remove mandatory legal rights relating to products purchased from us.


52. Limitation of Liability

To the maximum extent permitted by applicable law, AdaptAbility will not be liable for indirect, incidental, special or consequential losses arising from use of our Digital Services where such liability may legally be excluded.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Nothing in these Terms limits:

  • Mandatory consumer rights

  • Statutory warranties or conditions that cannot be excluded

  • Rights relating to unfair business practices

  • Other remedies that applicable legislation requires to remain available


53. Improper Use of Products

AdaptAbility is not responsible for loss or injury caused by misuse of a product, including use contrary to:

  • Manufacturer instructions

  • Safety warnings

  • Weight limits

  • Intended use

  • Installation requirements

to the extent such responsibility may lawfully be excluded.

This does not limit liability that cannot legally be excluded.


54. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold AdaptAbility harmless from third-party claims resulting from:

  • Your unlawful use of our Digital Services

  • Your infringement of another person's intellectual property rights

  • Fraudulent activity by you

  • Your material violation of these Terms

This section does not require a consumer to indemnify AdaptAbility for AdaptAbility's own unlawful conduct or obligations that cannot legally be transferred to a consumer.


55. Consumer Protection Rights

Nothing in these Terms is intended to waive, restrict or exclude rights provided to consumers under applicable law.

For Alberta consumers, this includes rights under the Consumer Protection Act.

Depending on the circumstances, applicable law may provide rights concerning:

  • Internet sales contracts

  • Required pre-purchase disclosures

  • Delivery

  • Cancellation

  • Refunds

  • Misrepresentations

  • Unfair business practices

  • Statutory remedies

Where these Terms conflict with a mandatory consumer protection requirement, the mandatory legal requirement governs.


56. Internet Sales Contracts

Where an online purchase is subject to statutory internet-sales-contract requirements, AdaptAbility will provide information required by applicable law before the customer becomes contractually bound.

Depending on applicable legislation, this may include information regarding:

  • AdaptAbility's identity and contact information

  • Description of the products

Any statutory cancellation right applies notwithstanding another provision of these Terms.


57. Events Beyond Our Reasonable Control

We will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control where liability may lawfully be excluded.

Examples may include:

  • Severe weather

  • Natural disasters

  • Fire

  • Flood

  • War

  • Civil disturbance

  • Government action

  • Labour disputes

  • Carrier disruptions

  • Border closures

  • Customs delays

  • Supplier shutdowns

  • Widespread telecommunications outages

  • Major cyber incidents affecting external providers

We will make reasonable efforts to address affected orders.


58. Suspension or Termination of Digital Access

We may suspend or terminate access to some or all Digital Services where reasonably necessary because of:

  • Fraud

  • Abuse

  • Security threats

  • Illegal activity

  • Material violation of these Terms

Termination of access does not eliminate obligations arising from transactions completed before termination.


59. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the provision will be interpreted or limited to the minimum extent necessary where legally permitted.

The remaining provisions will continue in effect.


60. No Waiver

If AdaptAbility does not immediately exercise a right under these Terms, that does not necessarily mean we have waived that right.


61. Entire Agreement

These Terms, together with applicable incorporated policies and any separately accepted written agreement, constitute the agreement governing your use of our Services and applicable purchases.

They supersede earlier general Terms of Service relating to the same subject matter.


62. Governing Law

These Terms and transactions with AdaptAbility are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, subject to any mandatory laws that apply based on the customer's location or circumstances.

Nothing in these Terms deprives a consumer of protections or remedies that cannot legally be waived.


63. Disputes

We encourage customers to contact us directly if a problem arises.

We will make reasonable efforts to address legitimate customer concerns.

Nothing in these Terms prevents a consumer from exercising any right to:

  • Contact a consumer protection authority

  • Make a regulatory complaint

  • Bring a claim before a court or tribunal with jurisdiction

  • Exercise another remedy provided by law

We do not require Alberta consumers to waive statutory rights in favour of mandatory arbitration where such a requirement would be prohibited by law.
